This Seller Rules & Prohibited Items Policy (“Policy”) forms part of the MaxBidAuctions.com Terms of Service and applies to all sellers, bidders, buyers, businesses, organizations, and individuals using the Platform. The purpose of this Policy is to preserve marketplace integrity, protect users, promote lawful transactions, reduce fraud, and ensure a safe and trustworthy auction environment.

Failure to comply with this Policy may result in listing removal, auction cancellation, withholding of funds, account suspension, account termination, permanent removal from the Platform, referral to law enforcement authorities, legal action, or any combination thereof.

1. Seller Standards and Marketplace Expectations

Sellers are expected to conduct themselves honestly, professionally, and in compliance with all applicable laws and regulations. Every seller is responsible for ensuring that listings are accurate, truthful, complete, and not misleading. Sellers must provide sufficient information for bidders to make informed purchasing decisions and may not intentionally omit material facts that could affect bidding behavior.

The reputation of the marketplace depends upon accurate listings and ethical conduct. Sellers are therefore expected to maintain reasonable communication, fulfill transactions promptly, cooperate with buyers, and comply with all Platform requirements.

Repeated complaints, excessive disputes, poor fulfillment performance, deceptive practices, or patterns of buyer dissatisfaction may result in restrictions or removal from the Platform.

2. Listing Accuracy Requirements

All listings must accurately represent the item being offered for sale. Sellers must disclose material information relating to condition, authenticity, functionality, defects, restoration, repairs, missing components, damage, modifications, wear, age, provenance, ownership history, and any other information that a reasonable bidder would consider relevant.

Descriptions must not contain false statements, misleading claims, manipulated information, fabricated histories, unsupported appraisals, or exaggerated representations designed to inflate bidding activity.

If an item’s authenticity, age, manufacturer, artist attribution, rarity, or provenance cannot be verified with certainty, the seller must clearly disclose that fact within the listing.

3. Photographs and Images

Photographs are considered a material component of every listing. Sellers must upload clear and accurate images that reasonably depict the item being sold.

Images may not be digitally altered in a manner that conceals damage, defects, repairs, discoloration, wear, missing components, or other relevant conditions. Stock photography should generally be avoided unless specifically identified as such and accompanied by actual photographs of the item being sold.

The use of misleading images, manipulated photographs, AI-generated representations, or photographs depicting items other than the item being sold may result in immediate listing removal.

4. Authenticity and Counterfeit Goods

Sellers may only offer genuine merchandise for sale. Counterfeit goods, unauthorized replicas, knockoffs, forged collectibles, forged autographs, fraudulent luxury goods, unauthorized reproductions, and items that infringe intellectual property rights are strictly prohibited.

Where authenticity is uncertain, sellers must clearly disclose the uncertainty and may not represent items as authentic unless they possess a reasonable basis for making such representations.

MaxBid Auctions reserves the right to request supporting documentation, provenance records, certificates of authenticity, purchase receipts, expert opinions, or other evidence supporting authenticity claims.

5. Prohibited Items

The following categories of items are prohibited from being listed, sold, advertised, transferred, or promoted through the Platform:

Stolen property, illegally obtained goods, counterfeit merchandise, illegal drugs, controlled substances, drug paraphernalia, explosives, hazardous chemicals, toxic substances, biological hazards, unlawful firearms, prohibited weapons, destructive devices, fraudulent financial instruments, forged documents, fake identification documents, human remains, body parts, protected wildlife products, endangered species products, recalled products, illegal surveillance equipment, malware, stolen digital accounts, illegal services, and any item prohibited under applicable law.

This list is illustrative and not exhaustive. MaxBid Auctions reserves the sole right to determine whether any item is inappropriate for the Platform.

6. Restricted Items

Certain categories of items may be restricted and subject to additional review, verification requirements, documentation requirements, licensing requirements, age restrictions, jurisdictional limitations, or approval procedures.

Restricted categories may include precious metals, gemstones, luxury goods, vehicles, collectible firearms where lawful, high-value collectibles, alcohol where lawful, antiques, cultural artifacts, artwork, coins, currency, investment-grade assets, and regulated products.

MaxBid Auctions may require additional verification or may prohibit certain restricted items entirely at its discretion.

7. Shill Bidding and Bid Manipulation

Shill bidding is strictly prohibited. Sellers may not bid on their own auctions, encourage others to bid on their behalf, create secondary accounts, coordinate bidding activity, manipulate bidding outcomes, artificially inflate prices, or engage in any conduct designed to create a false appearance of marketplace demand.

Similarly, bidders may not collude with sellers, coordinate bidding activity, manipulate auction outcomes, or engage in conduct intended to distort legitimate market pricing.

Evidence of bid manipulation may result in immediate account termination and forfeiture of marketplace privileges.

8. Non-Paying Bidders

Submitting a bid through MaxBidAuctions constitutes a legally binding commitment to complete the purchase if declared the winning bidder.

Users who repeatedly fail to complete purchases may have bidding privileges suspended or permanently revoked. MaxBid Auctions reserves the right to impose account restrictions, administrative fees, collection procedures, or other enforcement measures where appropriate.

9. Off-Platform Transactions

Users may not use the Platform to identify buyers or sellers and subsequently complete transactions outside the Platform for the purpose of avoiding fees, commissions, marketplace oversight, dispute procedures, or Platform policies.

Attempts to divert transactions, exchange contact information for fee avoidance purposes, or otherwise circumvent marketplace systems may result in account suspension and forfeiture of seller privileges.

10. Shipping and Fulfillment Standards

Sellers are responsible for shipping sold items within a reasonable period following payment confirmation unless alternative arrangements are clearly disclosed.

Items must be packaged appropriately for safe transport and shipped using reputable carriers where applicable. Sellers are encouraged to maintain tracking information and shipping documentation.

Failure to fulfill orders, repeated shipping delays, excessive damage claims, or poor fulfillment performance may result in seller restrictions.

11. Chargebacks and Transaction Disputes

Where buyers initiate chargebacks, payment disputes, fraud claims, unauthorized transaction reports, or similar payment-related disputes, MaxBid Auctions reserves the right to investigate the matter and temporarily withhold seller proceeds during review.

Sellers agree to cooperate fully with investigations and provide supporting documentation upon request. Failure to cooperate may adversely affect dispute outcomes and account standing.

12. Marketplace Enforcement

MaxBid Auctions may investigate any listing, account, transaction, communication, or marketplace activity where policy violations are suspected.

Enforcement actions may include warnings, listing removal, bid cancellation, auction cancellation, transaction reversal, temporary restrictions, withholding of funds, account suspension, permanent account termination, referral to regulatory authorities, referral to law enforcement agencies, or civil legal action.

The Company may take enforcement action based upon user reports, internal investigations, automated fraud detection systems, third-party information, legal requirements, or any information reasonably believed to indicate a policy violation.

13. Seller Verification

MaxBid Auctions reserves the right to verify seller identities, business legitimacy, ownership information, addresses, tax information, banking details, inventory ownership, and legal authority to sell listed goods.

Verification requirements may be imposed at registration, before listing certain items, before receiving payouts, during investigations, or at any other time deemed necessary by the Company.

Failure to satisfy verification requirements may result in account restrictions, listing limitations, delayed payouts, or account termination.

14. Reporting Violations

Users are encouraged to report suspected fraud, counterfeit goods, prohibited items, policy violations, intellectual property infringement, deceptive listings, bid manipulation, or other misconduct through the reporting tools provided by the Platform.

MaxBid Auctions reserves the right, but not the obligation, to investigate all reported concerns and determine appropriate action in its sole discretion.

15. Policy Modifications

MaxBid Auctions reserves the right to modify, expand, revise, interpret, enforce, or update this Policy at any time. Updated versions shall become effective upon publication to the Platform.

Continued use of the Platform following publication of revisions constitutes acceptance of the revised Policy.
